These Terms apply to every aspect of the relationship between the user (the “User”) and the operator (the “Operator”) in connection with use of the App. Any individual notices or guidelines that the Operator posts in the App form part of these Terms.
Users are responsible for managing their own accounts. If any registration information is found to be false, or if an account is found to have been used without authorization, the Operator may suspend use of that account.
Copyright in the tasting notes, photos, ratings and other data that a User records in the App (“Recorded Data”) belongs to the User. The Operator handles Recorded Data only to the extent necessary to provide and improve the service and to respond to problems, and will not make it public or disclose it to third parties without the User’s consent. Please note that the label recognition feature sends the label photos contained in Recorded Data to an external AI service in order to read the wine’s details. The handling of personal information and further details of the recipients of that data are governed by the separately provided Privacy Policy.
In using the App, Users must not do any of the following.
The Operator may change the content of the App, or suspend or terminate its provision, by giving Users prior notice. Where unavoidable, such as for system maintenance, communication failures or natural disasters, the Operator may temporarily suspend provision without prior notice.
The App provides its basic features, including creating, searching and exporting records, free of charge. For the label recognition feature (AI analysis), there is a limit on the number of images that can be analyzed per month (if both a front label and a back label are analyzed, two images are counted). Once the limit is reached, label recognition is unavailable for the rest of that month, but you can always record wines manually. The count resets on the 1st of each month (Japan Standard Time).
You cancel the Premium plan through your settings on the App Store or Google Play. If you cancel, you can continue to use the Premium plan until the end of the period you have paid for. After that, the limit returns to that of the Free plan (the number of images already analyzed that month carries over). Whether a refund is available is governed by the terms of the App Store and Google Play.
The Operator may change the monthly limits and the prices. In each case, the Operator will announce the details and the effective date in advance in the App or on the website. Content you have recorded within the free scope will not become inaccessible because of a change in the limits or the offering of the Premium plan.
The Operator does not guarantee the accuracy of the brand, vintage and other details that the label recognition feature reads. The Operator shall not be liable for any damage that a User incurs through use of the App, except where the damage is caused by the Operator’s willful misconduct or gross negligence.
The Operator may change these Terms, when it deems necessary, by notifying Users. If a User continues to use the App after a change, the User is deemed to have agreed to the revised Terms.
These Terms shall be interpreted under the laws of Japan. If a dispute arises in connection with the App, the court having jurisdiction over the Operator’s location shall have exclusive jurisdiction by agreement.
These Terms are provided in Japanese and in English. If there is any discrepancy between the Japanese version and the English version, the Japanese version shall prevail.
